These Terms and Conditions ("Terms") outline the rules and regulations for the use of The Mind Point's website, located at www.themindpoint.org (the "Website"), and the services provided by The Mind Point, including but not limited to courses, internships, diplomas, workshops, therapy sessions, supervised sessions, and related programs (collectively, the "Services"). By accessing the Website or using any Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access the Website or use the Services.
The Mind Point reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Website or Services after any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.
1. Terminology and Definitions
The following terminology applies to these Terms and all related agreements:
- "Client," "You," and "Your" refer to you, the individual accessing the Website, enrolling in Services, or otherwise engaging with The Mind Point.
- "The Company," "We," "Our," "Us," and "The Mind Point" refer to The Mind Point, its affiliates, employees, and representatives.
- "Services" include all educational and professional development offerings such as courses, internships, diplomas, workshops, therapy sessions, supervised sessions, and any pre-recorded materials.
- "Party" or "Parties" refers to both the Client and The Mind Point.
All terms relate to the offer, acceptance, and payment necessary to provide our Services in accordance with applicable laws.
2. License and Intellectual Property
Unless otherwise stated, The Mind Point and/or its licensors own all intellectual property rights to the materials on the Website and in the Services, including but not limited to course content, recordings, diplomas, certificates, and any related documents. All intellectual property rights are reserved.
You may access and use materials from the Website and Services for your personal, non-commercial use only, subject to the following restrictions:
- You must not republish, sell, rent, sub-license, reproduce, duplicate, copy, or redistribute any materials from the Website or Services.
- You must not share, distribute, or make available any recordings, course materials, or proprietary content to third parties without express written permission from The Mind Point.
- Recording access for courses, internships, and pre-recorded Services is provided for a limited period of 3 months from the date of enrollment or access grant. After this period, access will be revoked without exception. No extensions, renewals, or reactivations will be granted under any circumstances.
Violation of these restrictions may result in immediate termination of access to Services, forfeiture of any payments made, and potential legal action, including claims for damages.
3. Professional Enhancement Disclaimer
All Services offered by The Mind Point are intended solely for professional enhancement and skill development. They are not equivalent to formal educational degrees, qualifications, or certifications from accredited institutions. Our diplomas and certificates are not Post-Graduate (PG) Diplomas, do not require or hold affiliation with the University Grants Commission (UGC) or any university, and are not recognized as equivalent to university degrees or PG Diplomas. We make no claims regarding credit transferability, eligibility for licensure, or equivalency to accredited programs. Participation in our Services does not guarantee employment, professional advancement, or any specific outcomes. You acknowledge that enrollment is at your own risk and discretion.
4. Enrollment, Registration, and Course Policies
Registration Confirmation
Once you register for any Service, your enrollment is confirmed and final. By registering, you confirm that you have reviewed and accepted all details, including timings, dates, faculty, and content, and waive any right to dispute them later.
Course Timings, Dates, and Schedules
No adjustments, rescheduling, postponements, or modifications to course timings, dates, or schedules will be made under any circumstances, including but not limited to personal conflicts, technical issues, dissatisfaction with faculty, mismatched expectations, or any other reasons. All schedules are fixed and non-negotiable from the point of registration. If you are unable to attend a scheduled batch due to any reason, you will forfeit your participation in that batch without refund or credit. Transfer to the next available batch may be permitted only under the following strict conditions:
- The original course batch has not yet started; or
- Extreme circumstances are demonstrated with verifiable proof, such as medical emergencies supported by official medical bills, doctor's certificates, or other irrefutable evidence of inability to attend (e.g., hospitalization records). Proof must be submitted in writing within 48 hours of the issue arising, and approval is at the sole discretion of The Mind Point. No other circumstances, including work commitments, travel, or personal dissatisfaction, will qualify.
Transfers are subject to availability in the next batch, and no guarantees are made regarding the timing, faculty, format, or availability of future batches. If no suitable batch is available within a reasonable timeframe (as determined by The Mind Point), no transfer or refund will be provided.
Students who attend even one lecture (or partial session) are ineligible for any transfer, regardless of complaints about faculty, timings, content, or other factors. Attendance constitutes full acceptance of the Service as delivered, and no disputes will be entertained thereafter. Repeated requests or complaints after partial attendance may result in immediate termination of access to all Services without refund.
Exams and Guidelines
All exams, assessment patterns, grading criteria, and guidelines set by the respective faculty or The Mind Point must be followed strictly and without exception. No adjustments, accommodations, questions, challenges, or changes to exams, patterns, guidelines, or results will be entertained under any circumstances. Marks will not be changed or adjusted unless the faculty decides to do so at their sole discretion, and no reasons, explanations, complaints, or appeals regarding marks or evaluations will be entertained. Failure to comply may result in disqualification, failure of the Service, or termination of enrollment without refund. You are responsible for ensuring you meet all prerequisites and technical requirements prior to enrollment.
Recording Access
Access to recordings for all courses, internships, diplomas, workshops, and pre-recorded Services is strictly limited to 3 months from the date of enrollment or initial access grant. This access is non-transferable, non-extendable, and will be automatically revoked after the 3-month period without notice or exception. No requests for extensions, even for medical or personal reasons, will be considered.
User-Generated Content
Certain Services may allow you to post comments, feedback, or other content. Such content does not reflect the views of The Mind Point, and we are not liable for it. We reserve the right to remove any content that violates these Terms or is deemed inappropriate, offensive, or disruptive. Posting false, defamatory, or harassing content may lead to termination of Services and legal action.
5. Terms for Therapy and Supervised Sessions
Scheduling and Adjustments
Appointments for therapy sessions (individual, couples/family, group) and supervised sessions (individual, group, case discussion) are fixed upon booking and confirmation. No adjustments, rescheduling, cancellations, or modifications will be permitted under any circumstances, except in cases of extreme emergencies (e.g., medical issues with verifiable proof as described in Section 4). Missed sessions due to non-attendance, tardiness, or any other reason will not be rescheduled or refunded. Sessions must be attended in full; partial attendance does not entitle you to extensions or credits.
Conduct During Sessions
Participants must adhere to all guidelines provided by the facilitator or faculty. Disruptive behavior, including but not limited to interruptions, non-participation, or technical issues on your end, may result in immediate removal from the session without refund or rescheduling.
Confidentiality and Liability
All sessions are conducted with the expectation of mutual confidentiality. However, The Mind Point reserves the right to disclose information if required by law or in cases of imminent harm. We are not liable for any outcomes, advice, or results from sessions, which are provided for enhancement purposes only.
Hypothetical Client Participation
Where applicable, participation as a hypothetical client in supervised sessions is mandatory if assigned and must be completed respectfully and in full compliance with instructions. Failure to participate may result in disqualification from the Service.
6. Conduct and Respectful Treatment
All participants in Services must treat faculties, staff, fellow participants, and representatives of The Mind Point with the utmost respect and professionalism at all times. This includes but is not limited to:
- Refraining from harassment, discrimination, verbal abuse, or any form of disrespectful communication (e.g., complaints about faculty style, content, or personal attributes after enrollment).
- Adhering to session etiquette, such as being punctual, prepared, and engaged.
- Avoiding unfounded complaints or disputes, particularly after partial attendance, which will not be tolerated and may lead to immediate termination of Services without refund.
Violation of this policy may result in suspension or permanent ban from all Services, forfeiture of fees, and potential reporting to relevant authorities if warranted. The Mind Point's decision on conduct violations is final and non-appealable.
7. Certificates, Letters of Recommendation (LOR), and Remakes
- Certificates and diplomas are issued only upon successful completion of the Service and meeting all requirements, as determined solely by The Mind Point.
- Letters of Recommendation (LOR) are not included as part of any Service and may be requested separately, subject to approval and additional fees as determined by The Mind Point ( ₹500, payable in advance).
- Remaking or reissuing of certificates, diplomas, or any documents (e.g., due to loss, damage, name changes, or errors attributable to you) is not included in the Service fee. Such requests will incur additional charges (₹500 per document, payable in advance). No remakes will be provided for free under any circumstances.
8. Hyperlinking to Our Content
Approved organizations may hyperlink to our Website under the following conditions:
- Use of our corporate name, URL, or other appropriate description that fits the context.
- No use of our logo or artwork without a trademark license agreement.
We reserve the right to request removal of any link at our discretion.
9. Content Liability and External Links
We are not responsible for content on external websites linked to or from our Website. Links do not imply endorsement, and we disclaim liability for any loss or damage arising from such links.
10. Reservation of Rights
We reserve the right to:
- Request removal of any unauthorized links or content.
- Terminate access to the Website or Services for any user violating these Terms, without notice or refund.
- Amend these Terms at any time. Continued use after amendments constitutes acceptance.
11. Removal of Links from Our Website
If you identify an offensive link on our Website, contact us at themindpoint06@gmail.com. We will consider removal requests but are not obligated to respond or act.
12. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, we exclude all representations, warranties, and conditions relating to the Website and Services. Nothing in these Terms will:
- Limit or exclude liability for death or personal injury caused by negligence.
- Limit or exclude liability for fraud or fraudulent misrepresentation.
- Limit liabilities not excludable under applicable law.
The Mind Point will not be liable for any direct, indirect, incidental, consequential, or special damages arising from use of the Website or Services, including but not limited to loss of data, profits, opportunities, or emotional distress. All information and Services are provided "as-is" without guarantees of accuracy, completeness, availability, or suitability. Enrollment and participation are at your sole risk.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or use of the Website/Services shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
